CONSTITUTION

 

Constitution:   Revised as at September 1989.

1.    The Union shall be called The Perth & Kinross County Golf Union (hereinafter referred to
       as ‘The Union’)  and shall be in conformity with, and subject to the authority of the constitution of  The             
       Scottish Golf  Union.

2.    The Union shall be a federation of the clubs in the counties of Perth & Kinross.

3.    Objects:
       By virtue of the powers delegated to them by the Executive of the Scottish Golf Union the objects of The  
       Union shall be:
 a)  To administer and organise generally Amateur Golf in the counties of Perth & Kinross.
 b)  To institute and carry through, such competitions and matches as are considered appropriate by
       the Executive Committee hereinafter defined and which have the approval of the Scottish Golf Union.
 c)  To act as agents when required by the Scottish Golf Union in applying the rules of The Standard
       Scratch Score and Handicapping System.
 d)  To deal with matters of general interest to Amateur Golfers in The Union; if necessary in
       consultation with the subject to the overriding authority of the Executive Committee of
       The Scottish Golf Union.

4.   Membership:
      All golf clubs affiliated to the Scottish Golf Union through the Union shall be members of the Union.
      Clubs in membership as at the 1st of October in each year shall be liable to pay the Scottish Golf Union
      Such annual membership fees as are determined by the Executive Committee of the Scottish Golf Union.
      Any club in membership for part year only, shall notwithstanding be liable for the full
      year’s subscription.
      In addition to the annual membership fees payable to the Scottish Golf Union, the Union shall have power
      to call for any additional annual membership fee as may be required for the running of the Union which
      additional fee will be determined (if necessary) by the Executive Committee of the Union.
      Any club wishing to withdraw from membership must send written notice not later than the last day of
      September otherwise liability will remain for the subscription for the ensuing year commencing on
      1st October following.

5.   Executive Committee:
       The Executive Committee of the Union shall consist of delegates from the clubs all of whom must
       be members of clubs in affiliation with the Scottish Golf Union.
       Said delegates shall elect:  (a) A President and Vice-President;   A Secretary and Treasurer or
       Secretary/Treasurer, none of whom need be delegates.
       They should also elect:   An Executive Committee.   From this committee they should nominate
       a  Representative to the Executive Committee of the Scottish Golf Union.
       The President shall be elected for a term not exceeding two years and shall not be eligible for the
       succeeding term; on retrial from two years in office, he shall be an ex-officio member of the
       Executive Committee for the following year.
       The Executive Committee shall be composed entirely of Amateur Golfers. The number of the Committee
       Members (excluding President, Vice-President, Secretary and Treasurer or Secretary/Treasurer) shall
       not exceed NINE in number.      
       The offices of Secretary and Treasurer may be combined in one person. The Secretary and Treasurer
       shall have voting powers.
      
6.    The business of the Union shall be transacted and managed by the said Executive.

7.    Election of Executive:
        Each member club affiliated to the Scottish Golf Union shall be entitled to appoint one Delegate with
        Voting power to attend the Annual General Meeting. The Executive Committee shall be appointed at
        the Annual General Meeting by said delegates. Any other members of affiliated clubs may attend
        said annual meeting but will have no voting power.

8.    Annual General Meeting:
       The Executive Committee as defined in para 5 shall take office at the Annual General Meeting of the
       Union which shall be held during the month of  October at a venue decided upon by the
       Executive Committee in office for the time being.

9.    Extraordinary General Meeting:
       An Extraordinary General Meeting may be called on a written requisition signed by at least seven
       clubs within the Union. Such requisition shall specify the business to be transacted and it shall not be
       competent to deal with any other business at that Extraordinary General Meeting. On receipt of such
       a requisition, the Secretary, within ten days, shall notify all members of the Executive Committee
       and amendments must be received by him within seven days thereafter. Such a meeting shall be
       held within thirty days from receipt of the requisition at a venue as determined under Rule 8 hereof.

       At all meetings The President, whom failing the Vice-President, whom failing a member of the
       Executive Committee to be appointed by the meeting, shall take the chair. Each member of the
       Executive Committee shall have one vote only, except the chairman who shall have, if necessary,
       a casting vote as well as a deliberative vote. The quorum of meetings shall be five members.

10.    Powers of the Executive:
         In addition to the foregoing the Executive Committee shall have the following powers:
         (a)  To define the duties of the Secretary and Treasurer.
         (b)  To appoint sub-committees and Convenors thereof for any purpose connected with the Union
                and to invest them in such powers as they may consider expedient, including power to co-opt
                not more than two amateur golfers who are members of affiliated clubs within the Union.
         (c)  To control and apply the finances of the Union.
         (d)  To select or to arrange for selection of teams for matches approved by the Union and the
                 Scottish Golf Union.
         (e)  To decide all questions in matches, competitions and tournaments promoted by the Union
                subject to the right to appeal to the Royal and Ancient Golf Club of St Andrews, via the
                Scottish Golf Union.

11.     Finance:
          The funds of the Union shall be derived from (a) all entry monies for competitions etc which
          the Executive Committee mat deem expedient to impose;  (b)  any other voluntary contributions
          which may be received;  (c)  any additional membership fees which may be levied on the member
          clubs within the Union.

12.     Alteration to Constitution:
          The Constitution of the Union as approved by the Scottish Golf Union, shall not be altered or
          added to without the agreement of two-thirds of those present and voting at the Annual
         General Meeting convened for the purpose. Notice of any proposed alteration or addition shall be
          signed in the same manner and the procedure shall be the same in all respects as with reference
          to requisition for an Extraordinary General Meeting under pare 9 hereof. No alteration will be
          embodied in the Constitution without the approval of the Scottish Golf Union.

13.     Interpretation:
          (a) ‘Golf Club’  shall mean any recognised Golf Club in membership of the Scottish Golf Union.
                The term ‘Golf Club’ shall not include Ladies Golf Clubs and in the case of mixed membership,
                 the male section only shall be included.
          (b)  ‘Course Owning Clubs’ shall mean Golf Clubs who either own, rent, lease or are identified
                  with a particular course or courses.
          (c)  ‘Non Course Owning Clubs’ shall mean Golf Clubs which are formed by trade associations,
                 school former pupils  etc, and which are not in any way identified with a particular golf
                 course or courses.
